MJV Services Website Service - Terms and Conditions.​

By paying for our website service and subscribing to our hosting you acknowledge and accept the following terms and conditions:

• You are paying us the initial payment of £199.00 to create your website.  Please note that after you have approved the website and it has been published this payment is non-refundable, unless your website permanently fails to operate for any reason not of your doing in the first 12 months, in which case you will be offered a refund for this amount or credit, as you prefer.

• We are not hosting your website; this is provided by Yola, whose product we are reselling.  You will not be dealing with Yola in any capacity, and we do not imply that they do not endorse our service in any way.  Any enquiries, problems, payment and concerns should be imparted to us and we will take full responsibility for their resolution.  Please be aware that Yola will not discuss your website with you should you choose to contact them, as we will be their customer.

• We are obliged to inform you that you can procure a similar product cheaper by dealing directly with Yola; we are charging you for our labour and expertise in building your website using Yola's website design tools.

• Payment for hosting will be taken via Paypal Subscription recurring payments.  This will not be set up without your signed permission and until after you have approved your website for publication.  If you decide not to proceed with publishing your website after we have built it but before publication you will be issued a full refund.

• Upon approval and at the time of publication your Paypal subscription will be set up, charged at £10.00 per month, to be taken on or around the same date monthly thereafter.  Your first monthly payment will be charged immediately. 

• Upon publication your website will be issued a Yola subdomain with the suffix ".yolasite" (usually www.[yourname].yolasite.com).  This is not transferable and remains the property of Yola after you stop using this service.

• If you have your own custom domain (e.g., www.[yourname].com) we will happily apply this to your published website at no additional cost, as part of the service.  This will be unlinked and returned for your use should you stop using our service.

• You are initially purchasing 6 pages, including Index, Products and/or Services, Contact, Blog, Events and Privacy Policy, all of which will be created for you.  If you decide not to include any of the pages there will be no reduction in the website building fee of £199.00. 

• As part of the service we will link your social media profiles and populate your books, events, etc.  Additional functions and pages can be added at any time later, for an hourly labour charge of £20.00, charged by Paypal invoice.

• We do not take any responsibility for the content included on your website, or any consequences which may arise from your choosing to publish it, including defamation and copyright issues, but we will not work with or promote any material we consider to be gratuitously explicit, exploitative, sexually abusive, harmful to children, hateful, inciteful to commit harm or criminal offence.  We reserve the right to refuse the service in full or in part at any time, if we feel we are being asked to be complicit in any of the above.

• We cannot guarantee uptime or upload/download speeds of Yola's servers at any time, and cannot be held liable in instances of diminished service in this respect.  We have worked with Yola for many years and are satisfied with the service provided, but will not vouch for this in any way; you are strongly advised to carry out your own diligence on Yola's server speed and reliability before purchasing this service.

CANCELLATION

• This service is offered on a non-contract basis and can be cancelled at any time, without notice, penalty or any additional cost.  Please note that no refunds will be given for the initial website building nor any part-months remaining.

• You can cancel your subscription without telling us, though we ask that you let us know as a courtesy, and to avoid any issues transferring your custom domain to a new website, if you have one.  If a payment is missed you will be contacted to confirm your intentions.  If we do not hear from you we will consider this permission to remove your website and release your custom domain to you within 7 days.  If you experience any issues with payment please let us know as a matter of urgency, to avoid such a scenario occurring erroneously.

YOUR DATA

• By using this service you are acknowledging that it may be necessary for us to use personal information you send us, and publish that which is deemed content for your website, and giving us permission to do so.  We will never publish anything you have not expressly approved.

• It may be necessary for us to access your social media profiles as part of the service.  We will seek your permission at the time when it is required for us to do so.

• Your personal information (not to be published), including contact information and payment provision will be retained by us for as long as it is necessary for us to carry out the service.  We will not use your data for any other reason nor pass it on to any third party, including Yola (with the exception of your custom domain, registered ownership of which is in the public domain).

• The data protection regulations of your region will be applied to you, and your website will be compliant with any relevant data laws in the region where it applies.
